Terms of Service

Legal Entity: Ulement Sdn Bhd (200801013779 / 815068-P) operating as WPCare.

1. Scope of Operations 

WPCare provides managed digital infrastructure services, including proactive WordPress maintenance, WooCommerce support, server management, and emergency malware remediation. By engaging our services, you authorise our engineers to access, modify, and manage your server architecture to maintain operational stability.

2. Maintenance Protocols & SLA

  • Staged Deployments: For clients on active maintenance plans, we test all core, theme, and plugin updates in an isolated staging environment before pushing them to production.
  • The Zero-Stress Guarantee: If your website is compromised while on an active WPCare Growth or Enterprise plan, we will execute a full forensic malware sanitisation and restore the site at zero additional cost.
  • Exclusions: This guarantee is void if the breach occurred due to client negligence. This includes sharing administrator passwords, granting FTP access to unverified third parties, or overriding our core security protocols.

3. Emergency Triage

For non-subscribed clients requesting one-time emergency support, services are billed hourly or at a fixed diagnostic rate. WPCare guarantees the immediate removal of malicious code but does not guarantee future immunity unless the client transitions to an ongoing active maintenance plan.

4. Commitments & Billing 

Meaningful infrastructure health builds cumulatively over time. Therefore, our core maintenance plans operate on a 12-month commitment. Invoices are generated monthly or annually. Failure to process payment will result in the immediate suspension of off-site backups, firewall monitoring, and proactive updates.

5. Limitation of Liability 

WPCare deploys enterprise-grade security and monitoring tools. However, no system is entirely impenetrable. WPCare, Ulement Sdn Bhd, and its engineers shall not be held liable for any indirect revenue loss, business interruption, or data loss resulting from server hardware failure at your hosting provider, unpatchable zero-day exploits, or unauthorised access caused by compromised client-side credentials.

6. Termination of Services 

Either party may terminate the agreement with a 30-day written notice prior to the renewal date. Upon termination, WPCare will relinquish all administrative access, disable our proprietary enterprise licences, and permanently destroy our stored off-site backups of your infrastructure.
